Document 99-Civil Minutes Filed in Life Paint vs. Pacific Pebbles/Paul Koury Puts the Pressure on Koury

Filed in the case of Life Paint vs. Paul Koury/Pacific Pebbles are Civil Minutes from the Court that places the case on hold and off calendar.

The filing puts severe pressure on Koury to settle up and sign by July 31st, else the case could be re-opened against Koury.

Taken from the document is this paragraph, showing that Pacific Pebbles/Koury has their backs against the wall, probably because Life Paint isn't going to let him fool around...

So what would I want if I were Life Paint? Well, for one I would want my Life Deck name all to my self, like www.lifedeck.com, Life Deck Installation Company would be no bueno for Pacific Pebbles to use...I would want all my legal fees, lost profits from stolen sales, insist that Westcoat can't use the name ALX or make the product...boy what else can you think of?

July 31 isn't far away...can't wait!

Composite Decks Recalled by Louisiana-Pacific; Decks Can Deteriorate and Break, Posing Fall Hazard

WASHINGTON, D.C. - The U.S. Consumer Product Safety Commission, in cooperation with the firm named below, today announced a voluntary recall of the following consumer product. Consumers should stop using recalled products immediately unless otherwise instructed.

Name of Product: Composite Decks

Units: About 48 million linear feet (decks vary in size)

Manufacturer: Louisiana-Pacific (LP) Corp., of Nashville, Tenn.

Hazard: The recalled decking can prematurely deteriorate and unexpectedly break. Consumers can fall through broken decking and suffer serious injuries.

Incidents/Injuries: LP has received 37 reports of composite decks breaking, resulting in 14 injuries, including a broken wrist, sprained ankle, minor lacerations and bruises.

Description: The recall includes outdoor deck board and railings sold under the brand names LP WeatherBest®, ABTCo., and Veranda®. They are composite products that look similar to natural wood and were sold in various colors including Tuscan Walnut/Chestnut, Driftwood Grey/Greystone, Pacific Cedar and Western Redwood. Veranda decking products were manufactured by multiple firms; only products manufactured by LP are included in this recall.

Sold at: The Home Depot (Veranda® brand) and building product dealers (LP WeatherBest® and ABTCo. brands) nationwide from January 2005 to August 2008 for between $1.50 and $2.25 per linear foot.

Remedy: Consumers with the recalled decking should immediately contact LP for a free inspection. If the decking is affected by premature deterioration, LP will arrange for a free replacement.

LIFE PAINT vs. PACIFIC PEBBLES/PAUL KOURY IT'S ALL OVER! Parties have filed in court that they have settled their differences.

Who cried Uncle and saw the writing on the wall? Probably Paul Koury/Pacific Pebbles, but we won't know unless/until the settlement documents are signed and filed with the court in Santa Ana...

On Thursday July 2, the two parties filed a document saying that " the parties have agreed in principle to settle. The settlement is subject to the parties agreeing upon and executing final settlement documents and consent agreement, which is currently being drafted by the parties."

So who cried uncle? I'll guess that Pacific Pebbles/Koury flinched; the evidence seems to be overwhelming and Koury has the most to lose with any airing of dirty laundry, at least in my mind.

It ain't over til the fat lady sings, but I think she landed on Koury and now it's just a matter of time...watch for updates after July 31st for new documents/settlement papers...but I bet Koury wants that information kept on the qt.

Glass Balconies at the Sears Tower...

CHICAGO – Visitors to the Sears Tower's new glass balconies all seem to agree: The first step is the hardest.

The balconies are suspended 1,353 feet in the air and jut out four feet from the building's 103rd floor Skydeck. Their transparent walls, floor and ceiling leave visitors with the impression they're floating over the city.

"It's like walking on ice," said Margaret Kemp, of Bishop, Calif., who said her heart was still pounding even after stepping away from the balcony. "That first step you take — 'am I going down?'"

Kemp was among the visitors who got a sneak preview of the balconies Wednesday. "The Ledge," as the balconies have been nicknamed, open to the public Thursday. Visitors are treated to unobstructed views of Chicago from the building's west side and a heart-stopping vista of the street and Chicago River below — for those brave enough to look straight down.

John Huston, one of the property owners of the Sears Tower, even admitted to getting "a little queasy" the first time he ventured out. But 30 or 40 trips later, he's got the hang of it.

"The Sears Tower has always been about superlatives — tallest, largest, most iconic," he said. "Today is also about superlatives."
