From Mike Beaton at ICC-ES, an update on the "research" they are doing in regards to my claims that their ICC report is in contradiction to the Westcoat ALX installation instructions.
"In our last correspondence, I informed you that we were in communication with Westcoat and that is still true. We have a process that we follow when dealing with complaints. I can assure you that you will be informed when we have completed our review. I can also assure you that we are not ignoring your concerns.
Thank you for your patience. I am sure that if you were on the other side you would appreciate the opportunity and time to fully address the issues, as we are allowing Westcoat to do."
Sincerely,
Mike Beaton
OK I understand, Westcoat needs time to respond and provide stuff to ICC-ES, but really now, how long should this type of process take? We asked the question in our email back to ICC-ES, a copy is below...Hello John & Mike,
I received Mike’s email regarding the Westcoat ALX review, and indeed, I do appreciate the due process that must be provided to the report holder. I did feel like I was being ignored by a lack of acknowledgement to my email…there is just a lot of very interested parties waiting and watching.
I also wanted to let you know that I have a copy of a document (See attached PDf, pages 6, 7 & 8.)
from the current suit between Koury and Life Paint; a document that contains Koury’s admittance to referencing Life Paint’s ICC# 5416 which doesn’t say where, whether on literature or on actual product, and Westcoat admits that Life Paint demanded that Westcoat “cease and desist utilizing the Life Deck name and ICC number on it’s products. I also have a copy of an Life Deck Specialty Coatings, (a company owned separately from Life Paint, the holder of the ICC referenced) advertising brochure attached with Life Paints ICC # being used in the brochure. This ad was also a reason why the letter was generated by Life Paint, a copy of which I sent several weeks ago. To me it shows someone who will seek to bend, break or step over every rule he can to make a sale, and which appears to me to be a fraudulent act, deceiving installers and clients who believed they were getting a ICC-ES evaluated product. I hope that will not be construed at ICC-ES as “aggressive advertising”.
Koury also claims on page 22 section 30 that Life Paint has not adhered to sufficient quality control standards…well if that’s true, why didn’t he act on that to protect his “good” name? It seems it’s all about money and profit in their suit against each other…maybe something for ICC-ES to review as well.
I will wait to hear, is there a timeline of events that need to occur where you might give me some idea of when ICC-ES will be completed with their research and make a decision?
Thank you very much,
